VisageHosting.com’s Acceptable Use Policy (AUP) is designed to provide a clear understanding of the rules, regulations and restrictions regarding the use of VisageHosting.com’s services.

By registering for and using the services, and thereby accepting the terms and conditions of the Terms of Service Agreement or its equivalent, you agree to abide by the AUP as modified from time to time. Any violation of the AUP may result in the suspension or termination of your account or such other action as VisageHosting.com deems appropriate. An unlisted activity may also be a violation of the AUP if it is illegal, irresponsible, or disruptive use of the Internet. No credits will be issued for any interruption in service resulting from policy violations.

Illegal Usage

VisageHosting.com’s servers may be used for legal purposes only. Examples of illegal content include but are not limited to:

 •   Warez Sites.
 •   Hacker Programs.
 •   MP3s.
 •   Any Malware/Spyware content.

VisageHosting.com has a zero tolerance approach to any illegal content and will suspend any account found to have any such content. Furthermore VisageHosting.com will fully cooperate with any criminal investigation made into content hosted by our clients.

Adult Content

All legal adult content is allowed on our servers.

Server Usage

Any customer that is using a high amount of server resources (i.e. network resources, CPU time) will have their account suspended until this usage is reduced. VisageHosting.com is the sole arbiter for deciding what constitutes a high level of server resources.

99.9% Uptime Guarantee

In the event that your web site is not available for less than 100%, VisageHosting.com will credit the following month's service fee as follows. For any shared hosting client, such credit shall be retroactive and calculated as below measured 24 hours a day in a calendar month, with the maximum credit not exceeding fifty percent (50%) of the monthly service charge for the affected month. Monthly Uptime Credit:

 •   95% to 99.9% your account will be credited 10% of your monthly hosting fee
 •   90% to 94.9% your account will be credited 20% of your monthly hosting fee
 •   89.9% or below your account will be credited 50% of your monthly hosting fee

In order for you to receive a credit on your account, you must request such credit within seven days after you experienced the down time. You must request credit by sending an email message to support@visagehosting.com. Credit shall not be provided to you in the event that any outage is resulted from:

 •   Scheduled maintenance as posted from time to time at Host Department LLC.
 •   Your behavior or the performance or failure of your equipment, facilities or applications.
 •   Circumstances beyond Host Department LLC's reasonable control

Security

Customers are responsible for using our servers responsibly in a manner that does not affect the service to any other VisageHosting.com customers. Such forbidden uses include, but are not limited to:

 •   Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic.
 •   Attacking or attempting to gain unauthorized access to servers or services that belong to VisageHosting.com or its customers.
 •   Behaving in a manner which results in adversely affecting VisageHosting.com’s network or any customer’s access to it.

UCE (Unsolicited Commerce Email) – SPAM

Customers of VisageHosting.com may not use or permit others to use our network to transact in SPAM. Customers of VisageHosting.com may not host, or permit hosting of, sites or information that is advertised by SPAM from other networks. Violations of this policy carry severe penalties, including termination of service. VisageHosting.com will be the sole arbiter as to what constitutes a violation of this provision.

Chat Rooms

Chat rooms are allowed on our servers on the provision that they are nothing to do with IRC or p2p.

Background Running Programs

While backup running programs are allowed on our servers if any are found to interfere with normal server operations the account responsible will be suspended immediately until the programs are removed. Repeated abuse will lead to account termination.

IRC

VisageHosting.com does not allow IRC server, IRC bots, or IRC shells or anything related to IRC to be operated on our servers. Violations of this rule will be result in account suspension.

Backups

VisageHosting.com will perform backups on all servers on a daily basis. However we are not responsible for any loss or corruption of data due to faulty or non-existent backups. Users are responsible for their own backups and should regularly perform backups themselves.

Domain Names

VisageHosting.com will take the necessary actions to secure a domain name requested by a customer. However it is then the customer’s responsibility for domain name renewal. VisageHosting.com is not responsible for renewal.

Reseller Accounts

For clients taking advantage of our reseller accounts it is your responsibility to ensure that your clients adhere to both our Terms of Service and our Acceptable Use Policy. You will be hold solely responsible should any of your clients perform any activities that do not conform to these policies.

VisageHosting.com does not permit our reseller clients to advertise or grant accounts to their own clients with the intent of them to resell. VisageHosting.com will be the sole arbiter for deciding if this rule has been breached.

Client Responsibility

The client is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery. The client assumes responsibility for all material on their site that may be put on by a third party.

Modification

VisageHosting.com reserves the right to add, delete, or modify any provision of this Policy at any time without notice.

Refusal of Service

VisageHosting.com reserves the right to refuse, cancel, or suspend service at our sole discretion.
